Standard Terms and Conditions of Business for Applicants

The following Standard Terms and Conditions of Business apply to the services offered to applicants under the name "career international(me) portal for applicants" (hereinafter referred to as career international(me)) by bbw (Bildungswerk der Bayerischen Wirtschaft) gGmbH (hereinafter referred to as "bbw").

“career international(me)” is a project initiated and funded by vbm - Verband der Bayerischen Metall- und Elektro-Industrie e. V. and bayme - Bayerischer Unternehmensverband Metall und Elektro e. V. It is implemented by bbw.

1. General information, scope of application
The subject of these terms and conditions is exclusively the use of the products,
services and databases that bbw, Infanteriestr. 8, 80337 München, Germany, makes available in the publicly accessible section of the Internet platform for individuals operated under the label “career international(me)”. bbw provides an Internet-assisted platform on which the member companies of bayme vbm and applicants can find one another. bbw renders its services for applicants free of charge based on an accommodation relationship. Applicants have no legal right to the provision of bbw’s free services. The free services are rendered exclusively under the terms and conditions regulated here.

Online profile
Applicants can file an online application on “career international(me)”. The applicant can access the stored profiles at any time online. This is done by applicants using their personal account/password via "Login".

Entering personal data
Applicants can enter their personal data in the input forms/fields of a database on “career international(me)”. By entering the data on “career international(me)” the applicant agrees to all his documents being available to the co-ordinating office for them to be passed on. With executives’ applications, if there are uncertainties about the matching between the post advertised/interested company and applicant, this will be discussed with the applicant before the applicant’s data are passed on to the company.
Member companies of bayme vbm can also access the professional data online.  When they do, the applicants’ personal data remain anonymous and cannot be viewed by companies. The data can be revised and added to by the applicant at any time. When the applicant is no longer actively seeking a job he is obliged to delete his personal profile.

2. Confidentiality, data protection
bbw undertakes not to disclose the applicant’s personal data that bbw receives from the applicant under this contract. Both sides agree to comply with all applicable data protection legislation.

Pursuant to the Data Protection Act the applicant is informed herewith that bbw will store his data in machine-readable form and process them mechanically for the purposes of its services.

At first the data entered by the applicant are visible to the companies anonymously. If they are interested in making contact, employers can write to bbw’s co-ordinating office. The co-ordinating office matches the anonymous CVs with the jobs advertised. If there is a match, the applicant’s complete profiles are sent to the company. This process does not require any clearance from the applicant because clearance was given when the applicant registered. The co-ordinating office also informs the applicant of the company’s wish to make contact. With executives’ applications, if there are uncertainties about the matching between the post advertised/interested company and applicant, this will be discussed with the applicant before the applicant’s data are passed on to the company.

3. Accessing, editing and deleting profile and registration
The profile and the registration can be amended or deleted online at any time. This is done by applicants using their personal account/password via "Login".

It is the applicant’s duty when using IDs, passwords, user names or other security devices made available in connection with career international(me) to exercise the utmost care and to take all steps to ensure the confidential and secure treatment of the data and prevent their disclosure to third parties.

To maintain the profile, every three months an activation link is mailed out. The applicant is obliged to confirm this within 14 days. If bbw receives no reply to this query, the applicant’s access and data are deleted automatically.

4. Access to the anonymous CVs
bbw makes the anonymous CVs accessible only to the member companies of bayme vbm. Access is solely via the closed members’ section of bayme vbm. The personal registration data are not passed on.

5. Creating an accurate profile
The applicant undertakes to draw up his profile accurately and to update it whenever there are any changes. bbw reserves the right to refuse to post CVs on the database or to remove CVs and applications that have been posted. This applies insofar as content already published on the Internet violates legal requirements, official prohibitions, third-party rights or public morals (“inadmissible content“). The same applies if the applicant’s profile contains links that lead directly or indirectly to Websites with inadmissible content.
The applicant’s profile can be removed in the event of improper use.

If a claim is made against bbw for inadmissible content or other violations of law for which the applicant is responsible, the applicant shall indemnify bbw on first demand. The indemnification encompasses the requisite costs of asserting legal rights.

The applicant guarantees that all the content and parts thereof published by him on the Internet or his own submitted to bbw for publication are unencumbered by third-party rights. The customer shall reimburse bbw for loss or damage caused by a breach of this provision upon first demand.

6. Liability
bbw is not liable for the content of the information provided nor for it being up-to-date, correct and complete. Moreover, any liability towards the applicant is totally excluded, and towards third parties excluded on principle.
This exclusion of liability does not apply:
a. to liability on the part of bbw for intent;
b. if loss or damage owing to injury to life, limb or heath is due to a negligent dereliction of duty by bbw or to wilful or grossly negligent dereliction of duty on the part of its legal representatives or vicarious agents;
c. if loss or damage was caused by gross negligence on the part of bbw or by gross negligence or intent  on the part of its legal representatives or vicarious agents;
d. to liability for the breach of such cardinal duties as are indispensable for the achievement of the aim of the contract (cardinal duties);

7. e-mail use
The applicant consents explicitly to his e-mail address being used for the requisite information to be sent out in the context of “career international(me)”.
